Netherland’s Self-Employed Entrepreneur Program

For starting a business in the Netherlands as a self-employed entrepreneur, you have a wide range of options: from opening a shop to starting your own consultancy firm which makes you a full-time or a part-time entrepreneur. Applicants from outside EU with no Dutch nationality wishing to start a business in the Netherlands have to comply with certain formalities of the Dutch Immigration Authorities which starts by applying for a long-term residence permit. Nevertheless, the intended business gets assessed on the basis of a “points system” by an agency which reports to IND (the Dutch Immigration authorities). This system is used to check whether the activities to be carried out will contribute to the Dutch economy or not.

Minimum requirements

The fundamental requirements for this program is that the applicant:

  • Qualify as an independent entrepreneur
  • Can establish a sole proprietorship of a private company (Ltd (BV)) and be the only shareholder, or own more than 25% of the shares
  • Accept to be the Director of Majority Shareholders of the business
  • Have a business plan
  • Can demonstrate being able to earn sufficient income as a self-employed entrepreneur (specially in the business plan)
  • Obtain at least 90 points in the point system:
    • (min 30 points out of 100): Personal experience
    • (min 30 points out of 100): Business Plan
    • (min 30 points out of 100): Added value for the Netherlands
  • Accept to have a primary residence in the Netherland (e.g.: six months a year)

Netherland’s Highly Skilled Migrant Employee Program

If the established business in the Netherlands is recognized by the IND and is considered as a highly skilled company, it can sponsor and hire new employees from outside Europe who are known as ‘highly skilled migrant employees’ of that company. Such applicant can also be a shareholder of the company and must obtain a long-term residence. The period of validity of the residence permit is equal to the term of the employment contract or appointment, with a maximum of 5 years.

Minimum requirements

Apart from the general requirements such as holding a valid passport and not being a danger to the Netherlands, here are the minimum requirements for applying as a highly skilled migrant employee:

  • have an employment contract with an employer or research institution in the Netherlands which is a sponsor recognized by the IND
  • Not having more than 20 % shares of the company
  • Can prove sufficient income
